性騷擾

性騷擾（英語：sexual harassment）是一種涉及使用顯性或隱性的性暗示的騷擾，包括不受歡迎的或不恰當的回報承諾，以換取性好處^[1]。性騷擾就是一種霸凌，性騷擾就是欺負他人；而雖說性騷擾受害者女性多於男性，但任何性別都有可能是性騷擾的受害者。

一些情況下，性騷擾與其他騷擾之間不易區別，特別是所謂的不受歡迎的示好。又例如出於玩笑或者其他善良動機而實施撫摸、摟抱、親吻等等普遍的社交禮儀是對人友好的，其本身不具有違反法律的原則^[2]。通常是加害者肢體碰觸受害者性別特徵部位，妨礙受害者行為自由並引發受害者抗拒反應，意圖前述之行為而尚未行動或騷擾未遂也是性騷擾。^[3]

性騷擾可分為一次傷害與二次傷害：一次傷害為單方面求歡；二次傷害包括求歡不成惡意中傷，造成受害當事人精神受創，人際關係受阻，職場地位受歧視待遇。

很多國家都立法規管性騷擾，該議題屬告訴乃論。常見於職場性騷擾，上司對下屬或是同事之間的性騷擾。性騷擾受害者也有可能為保全人際關係，強忍不悅感而不反抗，導致加害者得寸進尺。感受到性騷擾時，向他人求助，離開現場，盡量釋放明確訊息，表態制止，視為明智。有時性騷擾受害者可能是因為擔心報復，才不回報的，一項研究指出，光是在美國，就有75%的人，因為說出自己遭到性騷擾的事實而遭到報復。^[4]

性騷擾非常普遍，據一項2018年的研究，光是在美國，就有81%的女性和43%的男性曾經受過性騷擾，其中，77%的女性和34%的男性曾經受過言語性騷擾，而51%的女性和17%的男性曾受「鹹豬手」碰觸（鹹豬手指的是不受歡迎且帶有性意味的碰觸）。^[5]；另一項研究則指出，光是在美國，就有大約25%到85%的女性，在職場上曾受過性騷擾。^[4]

性騷擾的現代理解是一個新概念，可追溯至20世紀70年代。儘管其他有關概念早已在許多文化中存在。「性騷擾」的術語被用在1973年瑪麗·羅向（Rowe Mary）時任麻省理工學院主席和總管撰寫了關於各種性別問題的報告《土星環》（Saturn's Rings）中^[6]。羅曾表示，她相信自己不是第一次用這個詞，因為70年代初馬薩諸塞州的婦女團體已討論到性騷擾，但MIT可能是第一個討論到該話題並制定相關政策和程序的大型組織（麻省理工學院學術委員會）。麻省理工當時也承認針對女性膚色和種族的騷擾，會造成種族和性方面的傷害。麻省主席表示，騷擾（和偏袒）跟大學的任務對立，沒人能夠容忍。

在《我們的時代：一場革命的回憶錄》（1999）一書中，記者蘇珊·布朗米爾援引1975年認為他們創造了性騷擾一詞的康奈爾活動家：「我們八個人坐在辦公室里......為創作為我們發聲的海報的獻言獻策。我們想到了『性恐嚇』、『性脅迫』、『工作上的性剝削』等詞。這些稱謂似乎都不恰當。我們想要的東西，要涉獵微妙和非微妙持續性行為的整個範圍。有人想到了『騷擾』。『性騷擾！』瞬間，我們同意了，就是它了^[7]。」

這幾位活動家，林·法利、蘇珊·邁爾和Karen Sauvigne，組建了婦女工作協會，以及1976年由Freada Klein、Lynn Wehril和伊麗莎白·科恩-斯頓茨組建的反對性脅迫聯盟，都是1970年代末期把性騷擾帶到公眾視線的先鋒組織。

儘管這個詞還不是很多人知道，直至1990年代安妮塔·希爾目擊並指證美國最高法院法官克拉倫斯·托馬斯^[8]。由於希爾1991年的作證，美國和加拿大的性騷擾案件數量增加58%，並在穩步攀升^[8]。

總括來說，依照不少國家現行的立法，性騷擾的行為大約歸納為二種基本類型，一是「交換利益性騷擾」，另一為「敵意環境性騷擾」^[9]。

性騷擾可能會出現在各種環境當中 - 在職場、工廠、學院、好萊塢、音樂界等。^[10]^[11]^[12]^[13]^[14]^[15]^[16]在通常情況下（但非必然），侵犯者是富有權勢的一方，是受害人的上司(因年齡、社會地位、政治權勢、教育或勞資關係)；或希望用這種方式來獲取晉升等權勢。性騷擾關係的形式包括：

侵犯者可能是任何人，例如客戶、同事、親戚、家長或合法監護人、教師或教授、學生、朋友或陌生人。
受害人不一定是被騷擾的當事人，也可能是這種行為的目擊者，感到這種行為十分令人厭惡。
騷擾地點可能出現在學校、大學、職場或其它地方。
騷擾行為不一定有目擊證人。
侵犯者可能對自己的行為的侵犯性質毫不知情，可能對自己已經觸犯法律毫不知情^[17]。
有時，被騷擾的當事人可能沒有意識到自己受到了侵犯。
侵犯行為有時只發生了一次，有時卻是反覆出現的。
對受害人的負面影響包括各種壓力和退出社交、睡眠或飲食紊亂、損害身心健康等。
受害人和侵犯者可能是任意性別。
侵犯者不一定是異性。
並不以有肢體的接觸為必要，有時言語如黃色笑話、嘲弄甚至詢問隱私，以及其他帶有性意味的動作，都可能構成性騷擾。
有時，行為發生時，侵犯者自以為他們表明了態度，但是事實上人們對此產生了誤解。誤解可能是合理的，也可能是不合理的。一個不合理的例子是，某一富有成見的女性認為她不明白男士要求停止行為的明確表態。^[18]

在互聯網時代，社會交往，包括性騷擾在網絡里出現次數增加，例如在遊戲中出現的性騷擾。

是否構成性騷擾成立，不同國家的法律規定各有差別：

中華民國

分別於「性別平等工作法」、「性別平等教育法」及「性騷擾防治法」三部不同法律中加以規範。受到性騷擾者可提起申訴，並依照申訴人身分、是否為工作中，分別適用不同處理機制，也依行為的狀況最重可提起刑事告訴，及相關民事的求賠償。 交換式性騷擾是行為人要求對方以性利益作為工作、教育訓練、機會或服務等有關的利益。敵意環境性騷擾則是行為人有貶抑對方人格尊嚴、使對方感到冒犯或不受其歡迎的環境、或是影響對方的活動或學習、工作等生活的進行。至於在其他場合的違反意願的騷擾行為，也可能成立，但行為人若有觸摸隱私部分將可能成立性騷擾防治法第25條之「性觸摸罪」。

性別平等工作法

第12條：本法所稱性騷擾，謂下列二款情形之一：一、受僱者於執行職務時，任何人以性要求、具有性意味或性別歧視之言詞或行為，對其造成敵意性、脅迫性或冒犯性之工作環境，致侵犯或干擾其人格尊嚴、人身自由或影響其工作表現。二、雇主對受僱者或求職者為明示或暗示之性要求、具有性意味或性別歧視之言詞或行為，作為勞務契約成立、存續、變更或分發、配置、報酬、考績、陞遷、降調、獎懲等之交換條件。前項性騷擾之認定，應就個案審酌事件發生之背景、工作環境、當事人之關係、行為人之言詞、行為及相對人之認知等具體事實為之。

性別平等教育法

第2條第4款：性騷擾：指符合下列情形之一，且未達性侵害之程度者：（一）以明示或暗示之方式，從事不受歡迎且具有性意味或性別歧視之言詞或行為，致影響他人之人格尊嚴、學習、或工作之機會或表現者。（二）以性或性別有關之行為，作為自己或他人獲得、喪失或減損其學習或工作有關權益之條件者。

性騷擾防治法

第2條：本法所稱性騷擾，係指性侵害犯罪以外，對他人實施違反其意願而與性或性別有關之行為，且有下列情形之一者：「一、以該他人順服或拒絕該行為，作為其獲得、喪失或減損與工作、教育、訓練、服務、計畫、活動有關權益之條件。二、以展示或播送文字、圖畫、聲音、影像或其他物品之方式，或以歧視、侮辱之言行，或以他法，而有損害他人人格尊嚴，或造成使人心生畏怖、感受敵意或冒犯之情境，或不當影響其工作、教育、訓練、服務、計畫、活動或正常生活之進行。」
性騷擾防治法第25條：「意圖性騷擾，乘人不及抗拒而為親吻、擁抱或觸摸其臀部、胸部或其他身體隱私處之行為者，處二年以下有期徒刑、拘役或科或併科新臺幣十萬元以下罰金。」「前項之罪，須告訴乃論。」

美國

法律及實務認為，並非所有不受歡迎具有性意味的行為都會構成性騷擾。而須符合

合理人的標準(reasonable person standard)，以免過多訟累或過度偏向保護過於敏感的人
敵意環境的性騷擾行為須「嚴重或普遍」(severe or pervasive)

性騷擾和侵犯可以在中學、^[19]大學^[20]^[21]和職場通過教育來進行預防。^[22]至少，聯誼會針對男生的項目會產生「可持續性行為改變」。^[20]^[23]

美國有很多男女生聯誼會在成員下保證書的過程中採取措施預防欺辱行為（常常包括性騷擾）。很多希臘社團和全美大學都有反欺辱政策，對某些欺辱行為進行明確定義，並提供了預防性措施。^[24]

應對

性騷擾，顧名思義，不需要也不能被容忍。然而，常常有大量有效途徑冒犯和傷害到人們所克服的心理影響，遺留或是返回到社會，重新獲得私人關係中的健康感情，就當他們受到外界關係的傷害，重獲社會認可，恢復教育、工作等環境下集中注意力和製造力的能力時。這可能需要壓力管理和治療、認知行為療法^[25]和朋友家人的支持等等。

建議及時諮詢法律和心理，自我治療可能無法釋放壓力或消除創傷，輕率地報告給當局可能不會有預期的效果，可以忽略不計，還會進一步傷害到受害者。有些民間團體，可提供性騷擾受害者相關支持資源，以協助被害人。例如台灣現代婦女基金會藉「諮詢專線」服務^[26]，協助當事人釐清問題，對性騷擾涉及之法律、救濟途徑權益、事件帶來之衝擊，提供個別的因應討論保障自身權益。

女性反抗性騷擾行為的研究

1991年K.R.揚特做出一項研究，發現女礦工開發出三種主要對策處理工作中的性騷擾：「小姐」、「調情」和「假小子」。老年婦女工人是典型的「小姐」類，她們傾向於脫離男性，跟他們保持距離，使用髒話迴避，避免出現任何可能被解釋為暗示的行為。她們也往往強調外表和身為女人的風度。「小姐」的後果是很少誘惑、挑逗和性騷擾，但他們會接受最少好評及工資最低的工作^[27]。

年輕單身女性最為常見的是「調情」。作為一種防禦機制，她們謊稱自己成為性評論的目標時受寵若驚。為此，她們成了被視為「女性刻板印象的實施案例，尤其是缺乏權力，開發工作技能、建立身為礦工的社會和自我認同感的機會最少^[27]。

「假小子」指比「調情」要大的單身女性。她們試圖把自己從女性的刻板印象中分開，專注於煤礦工人的地位，試圖變得「厚臉皮」。她們用幽默、回擊、對自己的性談論或是交換回應騷擾。因此，她們往往被視為違反了性雙重標準的蕩婦或性濫交婦女，被男性騷擾的機會愈演愈烈。目前尚未清楚假小子策略是否會導致更好或更壞的工作任務^[27]。

該研究的結果可能是用於其他工作環境，包括工廠、餐廳、寫字樓和大學。結論是，個人應對性騷擾策略不太起作用，可能會對職場帶來無法預料的不良後果，甚至可能增加性騷擾的風險。不管婦女們如何應付性騷擾，似乎都處在進退兩難的局面^[27]。

對受害人的常見影響

部分嚴重的性騷擾會對受害人構成心理影響，影響人際關係，更時常造成工作、學習上被刁難、處分、甚至失去工作、遭到報復因而引發嚴重身心及財產的損害，不少受害者因此有強烈陰影甚至會患上憂鬱症等精神病。

抗議後的報復與迫害

對受害人的報復和迫害司空見慣，特別是針對敢於說實話的人。受害人如果發言指責性騷擾，常常會被貼上招惹是非的標籤，或是被控譁眾取寵。類似的案例如強姦或性侵犯中，受害人常常成為被指責對象，她們的外貌，私生活，性格都受到干擾和攻擊。^[28]他們承受着來自同事、領導、導師、同學甚至是朋友的敵意和孤立。他們成為群毆和關係攻擊的對象。^[29]

對於被騷擾的女性受害人來說，其他女性不一定會表示出同情。如果騷擾人是男性，持性別主義觀，嫉妒受害人，常常會慫恿其他女性對受害人保持敵對關係。^[30]擔心被騷擾，或成為報復或迫害的對象，也會使得一些女性助紂為虐。^[31]例如，當路易斯·詹森起訴埃弗利思·角岩性騷擾時，遭到了許多同事的攻擊 — 而這些同事有許多在日後加入了她的訴訟。^[32]女性甚至通過落井下石的手段來討好男性同事來占便宜。^[31]

受到性騷擾後，受害人常常會因消極行為而受到報復和迫害。例如，申訴者會被給予差評，所經營的項目會遭受破壞，工作或學習機會被拒絕，工作時間被篡改，以及其它影響生產力的事情會出現，或是在申訴後失去職場或校園晉升的機會，導致失業、被迫辭職或是乾脆被開除。報復行動可能包括進一步的性騷擾，包括對受害人的圍追堵截或人肉搜索等。^[30]^[31]不但如此，學校教授或雇主被指責性騷擾時，或是成為性騷擾的幫凶時，可能會將受害人永遠開除，或是惡意阻止受害人升入其他學校。加害人也常常憑藉證據可能不足，反過來控告被害人刑事誹謗罪或要求鉅額民事賠償，作為恐嚇加害人或報復受害人或其支持者的手段。

女權主義者，作家納奧米·沃爾夫（英語：Naomi Wolf）傾聽了遭受性騷擾受害人的經歷，寫道：

「

「對他們說出以下的一系列建議讓我感到羞恥：他們的確應該在是否申訴的問題上三思，畢竟令他們害怕的事情真的可能發生。據我所知，去申訴的後果並不比保持沉默強到哪裡去。我記得有一個人因為迫於同伴壓力而退學；也有很多人則在官方那裡碰壁。有的婦女說她們因一夜的金髮女郎而失去了學業；獎學金沒了，推薦信可望不可及。所有人都碰到了一連串的打壓流程。通常情況下，大學或學院的主要決策者——特別是私立大學——和被申訴的教職員工狼狽為奸；不單是為了自保，而且是為了學校的面子去極力壓制一些信息，而那些信息可以保護其他的婦女不受到傷害。他們的目標看來不是提供一個公平討論的論壇，而是控制他們的損失。」^{[注 1]}

社會學家海倫·華生採訪了另一位婦女，報道稱：「面對犯罪，公開地解決問題似乎比隱忍更加糟糕。我發現着比騷擾本身更加難對付。」^[34]

2019年8月，香港立法會議員何君堯如常用Facebook，表達個人政治觀點時與人爭吵^[35]。「修例風波」和「元朗暴力」爭論期間，雖然其中一位女網友勸他向警察自首，但何君堯卻要求對方「自慰」。結果引起性騷擾和性別歧視爭議，遭網友和媒體熱論。何君堯刪去部份言論，但未向女性道歉而否認指控，並稱：「對曱甴是沒有性騷擾的！」。之後，繼續與他人政見相對。^[36]^[37]^[38]

No one was met with a coherent process that was not weighted against them. Usually, the key decision-makers in the college or university—especially if it was a private university—joined forces to, in effect, collude with the faculty member accused; to protect not him necessarily but the reputation of the university, and to keep information from surfacing in a way that could protect other women. The goal seemed to be not to provide a balanced forum, but damage control.^[33]

原文：I am ashamed of what I tell them: that they should indeed worry about making an accusation because what they fear is likely to come true. Not one of the women I have heard from had an outcome that was not worse for her than silence. One, I recall, was drummed out of the school by peer pressure. Many faced bureaucratic stonewalling. Some women said they lost their academic status as golden girls overnight; grants dried up, letters of recommendation were no longer forthcoming. No one was met with a coherent process that was not weighted against them. Usually, the key decision-makers in the college or university—especially if it was a private university—joined forces to, in effect, collude with the faculty member accused; to protect not him necessarily but the reputation of the university, and to keep information from surfacing in a way that could protect other women. The goal seemed to be not to provide a balanced forum, but damage control.^[33]
