Auskultant (fra latin auscullare, lytte) var tidligere en tjenestemann som var innskrevet i et embedsverk og for sin utdannelses skyld fikk være med på verkets forhandlinger, men som ikke oppebar noen lønn eller hadde rett til å delta i beslutningene.
Det var (i Sverige) ofte brukt om en lærerstudent som for sin praktiske utdannelse satt med på andres undervisning, psykologkandidater samt som assistenter hos landmålere. I det svenske språk var ordet brukt innen rettsvesenet fra 1637 og allment fra 1864.[1]
I Danmark var en auskultant gjerne en person som etter særlig autorisasjon bisitter retten sammen med dommeren, ikke for å delta i sakens behandling eller pådømmelse, men derimot for å utdanne seg selv til dommervirksomheten.[trenger referanse] I eldre tid var auskultanter ikke ualminnelig forekommende i de kollegiale retter.[trenger referanse]
I andre land ble betegnelsen auskultant til tider brukt på samme måte,[2] men kunne også være tittel for visse under retten ansatte assisterende embedsmenn.
