Substantive due process

實質性正當程序（substantive due process）是一項原則，在美國憲法中，是允許法院保護某些基本權利免受政府干預，即使程序保護是存在的，也沒有特別提到其他權利；實質性正當程序界定法院所持有的行為之間的界線，受政府管制或立法的約束，以及法院在政府干預範圍之外的行為。美国宪法第五修正案
