在英国,国会议员(英语:Member of Parliament,缩写:MP),是透过全民直接选举产生的下议院议员,每名都是各自在650个其中一个的国会选区以领先者当选制当选。《2011年定期国会法》规定除列明情况外,下议院须最少每五年改选一次,所以每名国会议员的每届任期最多亦为五年。
上议院虽然是国会构成的一部分,但该院的议员并不会被称为国会议员,仅为上议院议员(Member of the House of Lords)。
职责
根据温斯顿·丘吉尔所撰的《国会议员的职责》[1],国会议员首要的责任是谨以至诚、不偏不倚地,作保存联合王国荣誉和安全的决定。第二才是对选民负责,国会议员是被选民选作他们的代表(representative),不是受他们委派的人(delegate)。最为次要的责任则是对政党的团体或计划负责。国会议员都应该要有这三种忠诚,但任何一个健康民主体制的体现在于,国会议员毋庸置疑能按这个次序行事。[2][3][4][5][6]
议席空缺
如出现议席空缺,若非大选临近,该选区则需为余下任期举行补选。国会议员是不能以任何原因成功提出请辞的,离任议席的唯一方法是因“担任会接受君主收益的职位”(office of profit(英语:Office of profit) under the Crown)而被剥夺出任国会议员的资格,故此产生了现代国会议员的辞职方式。另外,1981年人民代表法(英语:Representation of the People Act 1981)规定,任何现任国会议员如被判处一年或以上监禁,将立即离任。2015年罢免国会议员法(英语:Recall of MPs Act 2015)授权选民,按国会议员的某些轻微违法行为去联署罢免请愿书,如同一国会选区内超过百分之十的选民参与联署该罢免请愿书,该选区议席亦会被腾空。
参选资格
参选国会议员只有两个条件。参选人需要年满18岁,以及是英国公民(不需要持英国国籍)、或是共和联邦成员国公民、或是爱尔兰共和国公民。参选人不需要登记作选民,亦不需要是参选选区的居民。[7][8]
然而,按照1975年下议院取消资格法(英语:House of Commons Disqualification Act 1975),以下人士在所有国会选区并没有参选资格:
- 内务文官(即公务员,但不包括外交官)
- 警务人员(英语:Law enforcement in the United Kingdom)
- 正规部队服役的军人(不包括海军元帅、陆军元帅和空军元帅)
- 威尔士议会议员和北爱尔兰议会议员(不包括苏格兰议会议员)
- 上议院议员,以及
- 法官等等。
此外,破产人士以及正在服一年或以上刑期的在囚人士亦不能参选。[7][9]
