Proses hukum yang semestinya atau proses hukum yang adil adalah persyaratan hukum yang menyatakan bahwa negara harus menghormati seluruh hak hukum yang dimiliki seseorang. Proses hukum yang semestinya menyeimbangkan hukum yang berlaku di suatu wilayah dan melindungi seseorang darinya. Saat pemerintah diketahui mengadili seseorang tanpa mengikuti hukum yang berlaku, hal tersebut dapat dianggap melanggar proses hukum yang semestinya, sehingga melanggar aturan hukum.
Proses hukum yang semestinya juga ditafsirkan sebagai pembatasan terhadap proses hukum (lihat proses adil subtantif), sehingga hakim-hakim dapat menjamin keadilan dan kebebasan fundamental. Tafsir ini telah menjadi hal yang kontroversial.
