Kohtutäitur on Eesti Vabariigis vabakutseline isik, kellele riik on delegeerinud õigused ja kohustused viia riigi nimel läbi sundtäitmisega seotud toiminguid ehk täitetoiminguid.
Sundtäitmine on materiaalse õiguse maksmapanemine riikliku sunni abil. Kohtutäituri amet omab Eesti õigussüsteemis olulist kohta, kuna alles sundtäitmise käigus selgub, mida üks või teine materiaalse õigusega tagatud nõue väärt on ning kas seda on praktikas võimalik realiseerida. Täitur teostab täitetoiminguid täitemenetluse käigus. Täitemenetlus on seaduses sätestatud piirides ja ulatuses isiku põhiõigusi piirav menetlus. Täita saab vaid täitemenetluse seadustikus loetletud lahendeid ehk täitedokumente. Täitemenetluse läbiviimise protsessinormid tulenevad täitemenetluse seadustikust.[1] Lisaks täitetoimingutele teeb täitur ka seaduses ettenähtud ametitoiminguid, milleks on õigusabi osutamine, dokumentide kättetoimetamine ja pärandvara inventuuri läbiviimine.[2]
